The Faculty of Law, University of Karbala, discussed the doctoral thesis tagged “Civil Protection for Information Technology Works – A Comparative Study”, the thesis submitted by the student “Mohammed Ahmed Issa”.
The thesis aimed to show that the intellectual capital carried by the information work is considered the most valuable asset for many countries. The wave of legislation in the field of protecting these works is considered the third wave of the legislation of the information age or the so-called computer law, which revealed the existence of many shortcomings and shortcomings in The texts of the legislation in question that dealt with the issue of legal rooting to protect the right holder (whether he is an author of the work, a producer, an organizer, a distributor, or even a consumer).
The thesis also showed that the countries producing informational works have realized the extent of their growing importance, the extent of their impact, and the need for them in various fields, so they sought to protect them with effective legal protection so that protection appeared in public and private internal legislation, despite the crystallization of many general principles regulating intellectual property in-laws, However, the rapid pace of technical progress showed the need for the role of intellectual property legislation and copyright laws in order to ensure the necessary and appropriate civil legal protection for copyright.
The researcher reached a number of results and recommendations, the most important of which is that there are many controversial points and problems that the digital environment raises on the rights of the owners of the work, especially since many studies dealing with this topic did not refer or adopt a precise definition of the technical work, which still raises many opinions, as well as a statement The extent to which some of the actions carried out by the owner of the work affect his work, such as publishing via the international information network, especially in an environment in which publishing and modification are easy, with ease, quality, and low material costs.
